Intellectual Property Litigation
We carefully develop strategies regarding our clients’ patents, trademarks, copyrights and trade secrets to secure the broadest protection allowed by law. Often this alone creates a protected zone in which our client may operate without encroachment by competitors. Whenever possible, we work to preserve our clients’ rights without resorting to litigation. In many instances we actively seek alternative dispute resolution options to create win-win (and lower cost) solutions for both parties, and we have developed particularly creative resolutions in circumstances where the parties desire and/or necessarily will have continuing relationships.
But when the circumstances call for litigation, we will defend our clients’ rights utilizing the full force of our extensive litigation and intellectual property expertise.
We therefore regularly prosecute and defend litigation involving patent, trademark, Internet domain names and copyright infringement; trade secrets; computer hardware and software rights; confidentiality, nondisclosure and noncompetition agreements; unfair competition and false advertising claims; antitrust claims and counterclaims; and breach of contract, breach of warranty, fraud and negligent misrepresentation claims in connection with intellectual property rights.
Combining technical expertise with extensive courtroom experience, our intellectual property lawyers have represented clients nationwide before federal and state trial and appellate courts, the International Trade Commission, the Patent and Trademark Office Board of Appeals and Interferences and the Trademark Trial and Appeal Board.
On a global basis, we have been involved in disputes under all leading instructional rules including the International Chamber of Commerce, UNCITRAL, the American Arbitration Association and the China International Economic and Trade Arbitration Commission. Our lawyers have also cultivated a great depth of knowledge of local business conditions and practices, which is of immense value in managing and controlling these cases.
